These terms and conditions (“Terms”) apply to the CareJourney app for mobile devices and web browsers, together with any related services operated by Ebiw Info Analytics Pvt. Ltd. (collectively, the “Application”). Ebiw Info Analytics Pvt. Ltd. is referred to as the “Service Provider”, “we” or “us”.

By signing in to or using the Application, you agree to these Terms and to the CareJourney Privacy Policy. Please read them carefully.

1. Who may use the Application

CareJourney is a clinical workspace provided to hospitals and clinics (“Healthcare Organizations”) under a separate agreement with the Service Provider. It may be used only by staff whom a Healthcare Organization has authorized and given an account (“Users”), such as doctors, nurses, receptionists and administrators. It is not offered to the general public.

  • You must be at least 18 years old and legally permitted to use the Application in your jurisdiction.
  • You may use the Application only for your work for the Healthcare Organization that gave you access.
  • If these Terms conflict with your Healthcare Organization's agreement with the Service Provider, that agreement prevails for matters between the organization and the Service Provider.

2. Your account and security

  • Keep your sign-in details confidential. Do not share your account or let anyone else use it.
  • Use the hospital code and login provided by your Healthcare Organization. You may access only your own organization's data.
  • Sign out when using a shared device, keep your device protected with a screen lock, and keep the app updated.
  • Tell your Healthcare Organization's administrator and the Service Provider (support@ebiw.com) immediately if you suspect your account has been misused.
  • Do not use the Application on a jailbroken or rooted device. Doing so weakens the device's security and may stop the Application from working correctly.

You are responsible for activity carried out through your account, unless it results from the Service Provider's own failure.

3. Acceptable use

When using the Application you must:

  • access patient information only when you are authorized to and have a legitimate clinical or administrative need;
  • follow applicable law, professional standards, and your Healthcare Organization's policies on confidentiality and patient privacy;
  • enter information that is accurate to the best of your knowledge;
  • use internal messaging and notes professionally and only for patient care and work purposes.

You must not:

  • try to access data belonging to another Healthcare Organization, or another user's account;
  • test, probe or bypass the Application's security, or interfere with its operation;
  • copy, scrape, export or sell patient data except through features your Healthcare Organization has authorized;
  • upload malware, or content that is illegal, abusive, discriminatory or unrelated to patient care;
  • reproduce, modify, reverse engineer, decompile or create derivative works of the Application, except where the law expressly allows it.

The Service Provider may investigate suspected misuse, cooperate with the Healthcare Organization and lawful authorities, and suspend access where needed to protect patients, data or the service.

4. Clinical responsibility

The Application is a tool that supports clinical and administrative work. It does not provide medical advice and does not replace professional judgment.

  • Clinicians remain fully responsible for diagnoses, treatment decisions, prescriptions and the content of patient records.
  • Check information in the Application, including medication, allergy and lab data, before relying on it.
  • Do not rely on the Application in an emergency, or as the only way to reach a patient or colleague.
  • Your Healthcare Organization remains responsible for its legal duties on medical records, including how long they are kept.

5. Artificial intelligence features

The Application uses AI to transcribe consultations and draft notes (AI Scribe), summarize patient history, flag possible clinical alerts, extract data from documents, and answer questions through an in-app assistant.

  • AI output can be incomplete or wrong. Treat it as a draft: review, correct and approve it before it becomes part of a patient record or is used for a decision.
  • Before recording a consultation with AI Scribe, inform the patient and obtain consent as required by law and your Healthcare Organization's policies.
  • How AI services process data is described in the Privacy Policy. Audio and clinical text are not used to train public AI models.

6. Data and content

  • Patient information and other content entered into the Application belongs to the Healthcare Organization, which controls it.
  • Content you enter is visible only to authorized users of your Healthcare Organization, according to their roles. It is never made public.
  • You grant the Service Provider permission to store, process and display that content only as needed to operate, secure, support and improve the Application for your Healthcare Organization. The Service Provider does not sell it or use patient information for advertising.
  • Personal data is handled as described in the Privacy Policy.

7. Licence and intellectual property

Subject to these Terms and your Healthcare Organization's agreement, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Application for your work for that organization.

The Service Provider keeps all intellectual property rights in the Application, including its code, design, trademarks, logos and branding. Nothing in these Terms gives you any right to use the Service Provider's trademarks or branding. Do not remove or alter any copyright or proprietary notices in the Application.

8. Fees

The app is free to download. Access is provided to Users through their Healthcare Organization's subscription, and any fees are governed by that organization's agreement with the Service Provider. Users are not charged directly.

9. Availability, internet and updates

  • The Application needs an internet connection. Your mobile or internet provider's charges, including roaming, are your responsibility.
  • The Service Provider aims to keep the Application available but does not guarantee uninterrupted or error-free service. It may be unavailable during maintenance or because of events outside the Service Provider's control. Any service levels are set out in the Healthcare Organization's agreement.
  • The Service Provider may update or change the Application. Please install updates when offered; older versions may stop being supported or may not work properly.

10. Third-party services

The Application relies on third-party services, including Google Play Services, Expo, Google Cloud and MongoDB Atlas. Their use is described in the Privacy Policy. The Service Provider is not responsible for third-party services beyond what applicable law and its agreements require.

11. Suspension and termination

  • Your access ends when your Healthcare Organization deactivates your account, when you stop working for it, or when its agreement with the Service Provider ends.
  • The Service Provider may suspend or end your access immediately if you seriously breach these Terms, break the law, or put patients, data or other users at risk. For other breaches, it will normally give notice and a reasonable chance to fix the problem.
  • When your access ends, stop using the Application and sign out of it on your devices. Patient records remain with the Healthcare Organization, as described in the Privacy Policy.

12. Limitation of liability

To the fullest extent permitted by law:

  • the Service Provider is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, data loss or business interruption;
  • the Service Provider is not liable for clinical decisions, or for any outcome resulting from relying on information or AI output in the Application without professional review;
  • the Service Provider's total liability for any claim is limited as set out in the Healthcare Organization's agreement or, if none applies, to the minimum amount permitted by law.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law.

13. Indemnity

To the fullest extent permitted by law, you agree to indemnify the Service Provider and its officers, employees and agents against claims, losses and reasonable legal costs arising from your intentional misuse of the Application or your serious breach of these Terms. This does not apply to claims caused by the Service Provider's own negligence, breach of these Terms or breach of law.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to any mandatory law that gives you other rights, the courts at Kolkata, West Bengal have jurisdiction over disputes arising from these Terms. Please contact us first; we will try to resolve any concern informally.

15. General

  • Severability: if any part of these Terms is found invalid or unenforceable, it will be modified to the minimum extent needed, and the rest will remain in effect.
  • Entire agreement: these Terms, the Privacy Policy and your Healthcare Organization's agreement with the Service Provider together form the entire agreement on your use of the Application.
  • Changes: we may update these Terms. Material changes will be posted with a new effective date and notified in the Application or by email. Continuing to use the Application after that means you accept the updated Terms. Previous versions are available on request.
